Terms and conditions

1. Seller

The BAM Guitar Center online shop at www.bam-music.com is operated by:

BAM Guitar Center is a brand of LM TRADE d.o.o. (the "seller").

2. Scope of these terms

These terms govern purchases in the online shop www.bam-music.com. By placing an order, the buyer confirms that they have read and agree to these terms. For consumers, the Consumer Protection Act (ZVPot-1) and the Obligations Code (Obligacijski zakonik) also apply. If these terms conflict with the law, the law prevails.

3. Order and conclusion of the contract

• You add products to the basket, choose delivery and payment, and place the order by clicking the order button with an obligation to pay.
• Before placing the order, you can review and correct all details.
• The contract is concluded when you receive the order confirmation by email. The confirmation contains the order details, these terms and the information on the right of withdrawal.
• We store orders in electronic form. You can view them in your customer account or email us for a copy.
• The contract is concluded in Slovenian. English and Croatian versions of these terms are also available.

4. Prices

• All prices are in euros (EUR) and include VAT. The delivery cost is shown separately before you place the order.
• The price at the time you place the order applies.
• Prices in the online shop may differ from prices in our shops.
• If a price is shown incorrectly because of an obvious error, we will tell you. You can confirm the order at the correct price or cancel it free of charge.
• Images may be for illustration only. The product description and technical data are decisive.

5. Payment methods

• Card, PayPal, Google Pay or Apple Pay. Payment is processed by PayPal. We do not see or store your card details.
• Cash on delivery, paid in cash when you receive the parcel from Pošta Slovenije or when you collect it in store.
• Pro forma invoice (bank transfer) to account SI56 0223 4001 1205 876. After you place the order, you receive the payment details. We reserve the goods for 3 working days. We send them when we receive your payment.
• Leanpay, payment in instalments, for orders from EUR 50 to EUR 12,000, for customers with permanent residence in Slovenia. Leanpay decides on approval under its own terms.

6. Delivery

We deliver to Slovenia and Croatia with Pošta Slovenije. Delivery costs EUR 5 and is free for orders over EUR 80. You can also collect your order free of charge at the BAM Celje shop. All details are on the Delivery and payment page.

The goods remain the property of the seller until they are paid in full.

7. Right of withdrawal

A consumer can withdraw from the contract within 14 days of receiving the goods without giving a reason. The procedure, exceptions and the form are on the Right of withdrawal page.

8. Lack of conformity (material defect)

• We are liable under ZVPot-1 for any lack of conformity that existed at the time of delivery and becomes apparent within two years of delivery.
• If the lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery.
• Notify us of the lack of conformity within two months of the day you discovered it. Describe it precisely and let us inspect the goods.
• You can first ask for repair or replacement. If this is not possible or we do not do it within a reasonable time, you can ask for a price reduction or withdraw from the contract and ask for a refund.
• If the lack of conformity becomes apparent within 30 days of delivery, you can withdraw from the contract straight away.
• Email info@bam-music.com or bring the goods to the BAM Celje shop. We cover the shipping costs for goods that are not in conformity.

9. Guarantee

Products that come with a guarantee card are covered by the manufacturer's guarantee under the conditions on the card. For technical goods that must have a guarantee by law, it lasts at least one year. To claim under the guarantee, present the guarantee card and the invoice. The guarantee does not affect your rights for lack of conformity. Consumables (strings, drumsticks, reeds, drum heads and similar) usually have no guarantee.

10. Lowest price guarantee

If you find the same product at a lower price from another Slovenian retailer, send us their published offer and we will offer you the same price. This applies to products in the regular range that the retailer actually has available. It does not apply to closing-down sales, private sales or other special promotions.

11. Complaints and disputes

Send complaints to info@bam-music.com or by post to LM TRADE d.o.o., Trnoveljska cesta 2F, 3000 Celje. We confirm receipt within five working days. Within eight working days we tell you how we will handle the complaint, and we keep you informed of its progress.

We resolve disputes by agreement. The seller does not recognise any out-of-court consumer dispute resolution provider as competent for disputes that a consumer could start under the Out-of-Court Consumer Dispute Resolution Act (Zakon o izvensodnem reševanju potrošniških sporov).

14. Final provisions

We may change these terms. An order is governed by the terms that applied when it was placed. The content of the online shop (texts, photos, logos) may not be copied for commercial purposes.
